Please read this End-User License Agreement (“Agreement”) carefully before clicking the “I Agree” button, downloading or using Flashback Express 7 (the “Software”).
By clicking the “I Agree” button, downloading or using Flashback Express 7, you are agreeing to be bound by the terms and conditions of this Agreement.
If you do not agree to the terms of this Agreement, do not click on the “I Agree” button and do not download or use Flashback Express 7.
1. DEFINIZIONI
1.1 Software – Flashback Express 7.
1.2 You/User – the end user of Flashback Express 7.
1.3 Agreement – this End User License Agreement (EULA)
1.4 Blueberry Software Ltd. Partners – companies authorized by Blueberry Software Ltd. to sell its products or services.
1.5 Copyright holder – Blueberry Software Ltd.
2. LICENZA, USO E DISTRIBUZIONE DEL SOFTWARE
2.1 LICENZA
Questo software viene concesso in licenza, non venduto. Blueberry Software Ltd. concede all'utente una licenza limitata e non esclusiva ("Licenza") per l'installazione e l'utilizzo del Software a condizione che l'utente rispetti i termini e le condizioni del presente Contratto. Eventuali aggiornamenti futuri del Software potrebbero includere un Contratto di licenza con l'utente finale aggiornato. Si prega di leggerlo attentamente prima di installare gli aggiornamenti del Software.
2.2 TRASFERIMENTO
L'utente non può vendere, affittare, noleggiare o sublicenziare il Software a terzi. Questa licenza non è esclusiva e non è trasferibile.
Solo Blueberry Software Ltd. Partners sono autorizzati a rivendere le licenze del Software.
2.3 DISTRIBUZIONE
Il pacchetto di installazione del Software può essere distribuito liberamente, con le eccezioni indicate di seguito, a condizione che il pacchetto di distribuzione non venga modificato. Nessuna persona o società può chiedere un compenso per la distribuzione del Software senza il permesso scritto del detentore del copyright. Il Software non può essere abbinato o distribuito con qualsiasi altro pacchetto senza il permesso del detentore del copyright. Tutte le registrazioni video, le registrazioni audio e le schermate registrate con il Software possono essere utilizzate e distribuite liberamente, a condizione che ci si assicuri che siano conformi alle leggi locali applicabili (inclusa, ma non solo, la legge locale sul copyright).
2.4 TERMINAZIONE
I vostri diritti di licenza per il Software ai sensi del presente Contratto termineranno automaticamente senza alcun avviso da parte di Blueberry Software Ltd. se non rispettate qualsiasi termine o condizione del presente Contratto. Dopo la cessazione di questa Licenza, l'utente deve cessare di utilizzare il Software e nessun rimborso sarà disponibile.
2.5 CONSENSO ALLA RACCOLTA DEI DATI DI UTILIZZO, UTILIZZO DELLA SUA CONNESSIONE INTERNET
The Software by default collects anonymous technical information about your use of the application in order to provide an optimal customer support experience and to improve the functionality and usability of the Software.
You agree that the Software may use an internet connection to provide full functionality, including but not limited to: validating your license and checking for updates.
2.6 PROPRIETÀ
Tutti i diritti d'autore e tutte le altre proprietà intellettuali del software sono di proprietà esclusiva o concessi in licenza a Blueberry Software Ltd.. Questo Software è concesso in licenza, non venduto. Tutti i diritti non espressamente concessi qui sono riservati a Blueberry Software Ltd..
2.7 RESTRIZIONI
L'utente non può usare, copiare, pubblicare, condividere, emulare, clonare, affittare, noleggiare, vendere, modificare, decompilare, disassemblare, altrimenti decodificare, o trasferire il programma concesso in licenza, o qualsiasi sottoinsieme del programma concesso in licenza, eccetto quanto previsto da questo accordo. Qualsiasi uso non autorizzato comporterà l'immediata e automatica cessazione di questa licenza e può risultare in un'azione penale e/o civile.
You shall not attempt to gain unauthorized access to any portion or feature of the Software, or any other systems or networks accessed by the Software or to any Blueberry Software Ltd. server, by hacking, password “mining”, or any other illegitimate means.
L'utente non deve sondare, scansionare o testare la vulnerabilità di qualsiasi server di Blueberry Software Ltd., né violare le misure di sicurezza o di autenticazione su qualsiasi server di Blueberry Software Ltd. o qualsiasi rete collegata a questi server.

You shall not use any device, software or routine to interfere or attempt to interfere with the proper working of the Software, or with any other person’s use of the Software.
You shall not use the Software for any purpose that is unlawful or prohibited by this Agreement.
Blueberry Software Limited si riserva il diritto di bloccare qualsiasi attività limitata sopra descritta e di disabilitare gli account di qualsiasi utente impegnato in tali attività.
2.8 LIMITAZIONI D'USO SU PIÙ PC
Quando il software viene utilizzato senza pagamento, Blueberry Software Ltd. non pone limiti al numero di PC su cui è possibile installare il software.
If you have purchased a licence, then this licence may only be used on the number of PCs that were specified at time of purchase of the licence.
2.9 USO COMMERCIALE
Per l'uso commerciale del software è necessario acquistare una licenza.
Quando il software viene utilizzato senza pagamento, il software può essere utilizzato solo per rivedere, dimostrare e valutare il software e i video prodotti dal software non possono essere utilizzati per scopi pubblici o commerciali.
Le aziende e le organizzazioni commerciali/profit sono tenute ad acquistare una licenza. Gli individui che utilizzano il software in progetti che generano reddito sono tenuti ad acquistare una licenza.
3 FATTURAZIONE E RIMBORSI
While the Software may be used without payment, optional licences can be purchased from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment.
Le tasse e le spese possono essere rimborsate entro 30 giorni dalla data di acquisto. In una data successiva ai 30 giorni dalla data di acquisto, tutte le tasse e le spese non sono rimborsabili.
4 GARANZIE E LIMITAZIONI DI RESPONSABILITÀ
L'utente riconosce e accetta che l'intero rischio derivante dall'uso o dalle prestazioni del Software rimane a suo carico.
4.1 GARANZIA LIMITATA
IL SOFTWARE (COMPRESI, SENZA LIMITAZIONE, L'APPLICAZIONE SOFTWARE E LA DOCUMENTAZIONE) VIENE FORNITO "COSÌ COM'È" SENZA GARANZIE DI ALCUN TIPO, NÉ EXPRESS NÉ IMPLICITE, COMPRESE, SENZA LIMITAZIONE, GARANZIE O CONDIZIONI DI QUALITÀ, PRESTAZIONI, NON VIOLAZIONE, COMMERCIABILITÀ O IDONEITÀ ALL'USO PER UNO SCOPO PARTICOLARE. BLUEBERRY SOFTWARE LTD. NON GARANTISCE CHE I SERVIZI SARANNO ININTERROTTI, PUNTUALI O PRIVI DI ERRORI. L'USO DEL SOFTWARE E/O DEI SERVIZI È A PROPRIO RISCHIO.
4.2 LIMITAZIONI DI RESPONSABILITÀ
NÉ BLUEBERRY SOFTWARE LTD. NÉ I SUOI LICENZIATARI SONO RESPONSABILI IN ALCUN MODO PER QUALSIASI PERDITA O DANNO DI QUALSIASI TIPO DERIVANTE DAL SOFTWARE O DA QUALSIASI USO DI QUESTO SOFTWARE E/O SERVIZI, INCLUSO SENZA LIMITAZIONE LA PERDITA DI DATI, PERDITA DI AVVIAMENTO, PERDITA DI PROFITTI, INTERRUZIONE DEL LAVORO, GUASTO O MALFUNZIONAMENTO DEL COMPUTER, O QUALSIASI ALTRO DANNO O PERDITA.
NÉ BLUEBERRY SOFTWARE LTD. NÉ I SUOI LICENZIATARI SONO RESPONSABILI IN ALCUN MODO PER QUALSIASI COSTO AGGIUNTIVO, INCLUSO, MA NON LIMITATO A COSTI AGGIUNTIVI DA OPERATORI DI TELEFONIA MOBILE/TELECOMUNICAZIONE DERIVANTI DAI SERVIZI O QUALSIASI USO DEI SERVIZI.
NÉ BLUEBERRY SOFTWARE LTD. NÉ I SUOI LICENZIATARI SONO RESPONSABILI IN ALCUN MODO PER QUALSIASI DANNO O PERDITA DERIVANTE DALL'USO DEI SERVIZI DA PARTE DI QUALSIASI TERZA PERSONA O ORGANIZZAZIONE.
5 LEGGE APPLICABILE E DISPOSIZIONI GENERALI
Questo accordo è regolato da, e sarà interpretato in conformità con, le leggi di Inghilterra e Galles. Questo accordo può essere modificato solo da un addendum di licenza che può accompagnare o essere aggiunto a questa licenza.
