Flashback Video Converter

Please read this End-User License Agreement (“Agreement”) carefully before installing or using FlashBack Video Converter (the “Software”).

By installing or using FlashBack Video Converter, you are agreeing to be bound by the terms and conditions of this Agreement.

If you do not agree to the terms of this Agreement, do not install or use FlashBack Video Converter.

1. DEFINITIONEN

1.1 Software – FlashBack Video Converter

1.2 You/User – the end user of FlashBack Video Converter.

1.3 Agreement – this End User License Agreement (EULA)

1.4 Blueberry Software Ltd. Partners – companies authorized by Blueberry Software Ltd. to sell its products or services.

2. SOFTWARE LICENSE, USE AND DISTRIBUTION

2.1 LICENSE

This software is licensed and not sold. Blueberry Software Ltd. grants you a limited non-exclusive license (“License”) to install and use the Software as long as you comply with the terms and conditions of this Agreement. Any future Software updates may include an updated End User License Agreement. Please read it carefully before installing Software updates.

2.2 ÜBERTRAGUNG

Sie dürfen die Software nicht an Dritte verkaufen, vermieten, verleasen oder unterlizenzieren. Diese Lizenz ist nicht-exklusiv und nicht übertragbar.

Nur Blueberry Software Ltd. Partner sind autorisiert, Software-Lizenzen weiterzuverkaufen.

2.3 VERTEILUNG

Das Software-Installationspaket darf mit den unten genannten Ausnahmen frei verteilt werden, vorausgesetzt, das Verteilungspaket wird nicht verändert. Keine Person oder Firma darf ohne schriftliche Genehmigung des Urheberrechtsinhabers eine Gebühr für den Vertrieb der Software verlangen. Die Software darf ohne Genehmigung des Urheberrechtsinhabers nicht mit einem anderen Paket gebündelt oder verteilt werden. Alle mit der Software aufgezeichneten Video- und Audioaufnahmen sowie Screenshots dürfen frei verwendet und weitergegeben werden, vorausgesetzt, sie entsprechen den geltenden lokalen Gesetzen (einschließlich, aber nicht beschränkt auf Ihr lokales Urheberrechtsgesetz).

2.4 BEENDIGUNG

Ihre Lizenzrechte an der Software gemäß dieser Vereinbarung enden automatisch und ohne Benachrichtigung durch Blueberry Software Ltd., wenn Sie eine oder mehrere Bedingungen dieser Vereinbarung nicht einhalten. Nach Beendigung dieser Lizenz müssen Sie die Nutzung der Software einstellen, und es erfolgt keine Rückerstattung.

2.5 ZUSTIMMUNG ZUR ERHEBUNG VON NUTZUNGSDATEN, NUTZUNG IHRER INTERNETVERBINDUNG

The Software by default collects anonymous technical information about your use of the application in order to provide an optimal customer support experience and to improve the functionality and usability of the Software. If you do not agree to Blueberry Software’s collection of this information, do not install or use Software.

You agree that FlashBack may use an internet connection to provide full Software functionality, including but not limited to: validating your license and checking for Software updates.

2.6 EIGENBESITZ

All copyrights and all other intellectual properties to the Software are exclusively owned or licensed by Blueberry Software Ltd. This Software is licensed and not sold. All rights not expressly granted here are reserved by Blueberry Software Ltd.

2.7 EINSCHRÄNKUNGEN

Sie sind nicht berechtigt, das lizenzierte Programm oder eine Teilmenge des lizenzierten Programms zu verwenden, zu kopieren, zu veröffentlichen, weiterzugeben, zu emulieren, zu klonen, zu vermieten, zu verleasen, zu verkaufen, zu modifizieren, zu dekompilieren, zu disassemblieren, anderweitig zurückzuentwickeln oder zu übertragen, es sei denn, dies ist in dieser Vereinbarung vorgesehen. Jede derartige unerlaubte Nutzung führt zur sofortigen und automatischen Beendigung dieser Lizenz und kann straf- und/oder zivilrechtliche Folgen nach sich ziehen.

You shall not attempt to gain unauthorized access to any portion or feature of the Software, or any other systems or networks accessed by the Software or to any Blueberry Software Ltd. server, by hacking, password “mining”, or any other illegitimate means.

Sie dürfen weder die Verwundbarkeit eines Servers von Blueberry Software Ltd. untersuchen, scannen oder testen, noch die Sicherheits- oder Authentifizierungsmaßnahmen auf einem Server von Blueberry Software Ltd. oder einem mit diesen Servern verbundenen Netzwerk verletzen.

Sie dürfen keine Handlungen vornehmen, die eine unangemessene oder unverhältnismäßig große Last auf die Infrastruktur der Systeme oder Netzwerke von Blueberry Software Limited oder auf Systeme oder Netzwerke, die mit den Systemen oder Netzwerken von Blueberry Software Limited verbunden sind, auferlegen.

You shall not use any device, software or routine to interfere or attempt to interfere with the proper working of the Software, or with any other person’s use of the Software.

You shall not use the Software for any purpose that is unlawful or prohibited by this Agreement.

Blueberry Software Ltd. reserves the right to bar any restricted activity outlined above and to disable the accounts of any users engaging in such activities.

2.8 EINSCHRÄNKUNGEN BEI DER NUTZUNG AUF MEHREREN PCS

Wenn die Software unentgeltlich genutzt wird, setzt Blueberry Software Ltd. keine Grenzen für die Anzahl der PCs, auf denen Sie die Software installieren dürfen.

If you have purchased a license, then this license may only be used on the number of PCs that were purchased.

3. BILLING AND REFUNDS

While the Software may be used without payment, optional licenses are available from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment.

Gebühren und Kosten können innerhalb von 30 Tagen nach dem Kaufdatum erstattet werden. Später als 30 Tage nach dem Kaufdatum sind alle Gebühren und Kosten nicht erstattungsfähig.

4. WARRANTIES AND LIMITATIONS OF LIABILITY

You acknowledge and agree that the entire risk arising out of use or performance of the Software remains with the user. While the Software may be used without payment, optional licenses are available from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment. Fees and charges may be refunded within 30 days of the purchase date. At a later date than 30 days after the purchase date, all fees and charges are nonrefundable.

4.1 BESCHRÄNKTE GARANTIE

DIE SOFTWARE (EINSCHLIESSLICH, ABER NICHT BESCHRÄNKT AUF DIE SOFTWAREANWENDUNG UND DIE DOKUMENTATION(EN)) WIRD "WIE BESEHEN" UND OHNE JEGLICHE GARANTIE BEREITGESTELLT, WEDER EXPRESS NOCH STILLSCHWEIGEND, EINSCHLIESSLICH, ABER NICHT BESCHRÄNKT AUF GARANTIEN ODER BEDINGUNGEN FÜR QUALITÄT, LEISTUNG, NICHTVERLETZUNG, MARKTGÄNGIGKEIT ODER EIGNUNG FÜR EINEN BESTIMMTEN ZWECK. BLUEBERRY SOFTWARE LTD. ÜBERNIMMT KEINE GARANTIE DAFÜR, DASS DIE DIENSTE OHNE UNTERBRECHUNG, ZEITGERECHT ODER FEHLERFREI ZUR VERFÜGUNG STEHEN. DIE NUTZUNG DER SOFTWARE UND/ODER DER DIENSTE ERFOLGT AUF EIGENE GEFAHR.

4.2 HAFTUNGSBESCHRÄNKUNGEN

WEDER BLUEBERRY SOFTWARE LTD. NOCH IHRE LIZENZGEBER HAFTEN IN IRGENDEINER WEISE FÜR VERLUSTE ODER SCHÄDEN JEGLICHER ART, DIE SICH AUS DER SOFTWARE ODER DER NUTZUNG DIESER SOFTWARE ODER/UND DIENSTLEISTUNGEN ERGEBEN, EINSCHLIESSLICH UND OHNE EINSCHRÄNKUNG DATENVERLUSTE, VERLUST VON FIRMENWERT, GEWINNVERLUSTE, ARBEITSUNTERBRECHUNGEN, COMPUTERAUSFÄLLE ODER -FEHLFUNKTIONEN ODER ALLE ANDEREN SCHÄDEN ODER VERLUSTE.

NEITHER BLUEBERRY SOFTWARE LTD. NOR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR ANY ADDITIONAL COSTS, INCLUDING, BUT NOT LIMITED TO ADDITIONAL CHARGES FROM MOBILE/TELECOMMUNICATION OPERATORS ARISING OUT OF THE SERVICES OR ANY USE OF THE SERVICES. NEITHER BLUEBERRY SOFTWARE LTD. NOR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR ANY DAMAGES OR LOSS ARISING OUT OF THE USE OF THE SERVICES BY ANY 3RD PARTY PERSON OR ORGANISATION.

5 GELTENDES RECHT UND ALLGEMEINE BESTIMMUNGEN

Diese Vereinbarung unterliegt den Gesetzen von England und Wales und ist in Übereinstimmung mit diesen auszulegen. Diese Vereinbarung kann nur durch einen Lizenznachtrag geändert werden, der dieser Lizenz beigefügt oder hinzugefügt werden kann.
