Flashback Video Converter

Please read this End-User License Agreement (“Agreement”) carefully before installing or using FlashBack Video Converter (the “Software”).

By installing or using FlashBack Video Converter, you are agreeing to be bound by the terms and conditions of this Agreement.

If you do not agree to the terms of this Agreement, do not install or use FlashBack Video Converter.

1. DEFINITIES

1.1 Software – FlashBack Video Converter

1.2 You/User – the end user of FlashBack Video Converter.

1.3 Agreement – this End User License Agreement (EULA)

1.4 Blueberry Software Ltd. Partners – companies authorized by Blueberry Software Ltd. to sell its products or services.

2. SOFTWARE LICENSE, USE AND DISTRIBUTION

2.1 LICENSE

This software is licensed and not sold. Blueberry Software Ltd. grants you a limited non-exclusive license (“License”) to install and use the Software as long as you comply with the terms and conditions of this Agreement. Any future Software updates may include an updated End User License Agreement. Please read it carefully before installing Software updates.

2.2 OVERDRACHT

U mag de Software niet verkopen, verhuren, leasen of in sublicentie geven aan een andere partij. Deze Licentie is niet-exclusief en niet-overdraagbaar.

Alleen Blueberry Software Ltd. Partners zijn gemachtigd om Softwarelicenties door te verkopen.

2.3 DISTRIBUTIE

Het installatiepakket van de Software mag vrij verspreid worden, met de hieronder vermelde uitzonderingen, op voorwaarde dat het distributiepakket niet gewijzigd wordt. Geen enkele persoon of onderneming mag een vergoeding vragen voor de distributie van de Software zonder schriftelijke toestemming van de houder van het auteursrecht. De Software mag niet worden gebundeld of gedistribueerd met een ander pakket zonder toestemming van de houder van het auteursrecht. Alle video-opnames, audio-opnames en screenshots die met de Software zijn opgenomen, mogen vrij worden gebruikt en verspreid, op voorwaarde dat u ervoor zorgt dat ze voldoen aan de toepasselijke lokale wetgeving (inclusief, maar niet beperkt tot, uw lokale auteursrechtwetgeving).

2.4 BEËINDIGING

Uw licentierechten op de Software onder deze Overeenkomst worden automatisch beëindigd zonder enige kennisgeving van Blueberry Software Ltd. indien u zich niet houdt aan enige voorwaarde(n) of bepaling(en) van deze Overeenkomst. Na de beëindiging van deze Licentie, moet u het gebruik van de Software staken en zal er geen terugbetaling beschikbaar zijn.

2.5 TOESTEMMING OM GEBRUIKSGEGEVENS TE VERZAMELEN, UW INTERNETVERBINDING TE GEBRUIKEN

The Software by default collects anonymous technical information about your use of the application in order to provide an optimal customer support experience and to improve the functionality and usability of the Software. If you do not agree to Blueberry Software’s collection of this information, do not install or use Software.

You agree that FlashBack may use an internet connection to provide full Software functionality, including but not limited to: validating your license and checking for Software updates.

2.6 EIGENDOM

All copyrights and all other intellectual properties to the Software are exclusively owned or licensed by Blueberry Software Ltd. This Software is licensed and not sold. All rights not expressly granted here are reserved by Blueberry Software Ltd.

2.7 BEPERKINGEN

U mag het gelicentieerde programma, of een subset van het gelicentieerde programma, niet gebruiken, kopiëren, publiceren, delen, emuleren, klonen, verhuren, leasen, verkopen, wijzigen, decompileren, demonteren, anderszins onderwerpen aan reverse engineering of overdragen, tenzij zoals bepaald in deze overeenkomst. Elk dergelijk ongeoorloofd gebruik zal resulteren in de onmiddellijke en automatische beëindiging van deze licentie en kan leiden tot strafrechtelijke en/of burgerrechtelijke vervolging.

You shall not attempt to gain unauthorized access to any portion or feature of the Software, or any other systems or networks accessed by the Software or to any Blueberry Software Ltd. server, by hacking, password “mining”, or any other illegitimate means.

U zult de kwetsbaarheid van een server van Blueberry Software Ltd. niet peilen, scannen of testen, noch de veiligheids- of authenticatiemaatregelen op een server van Blueberry Software Ltd. of een netwerk dat met deze servers is verbonden, schenden.

U zult geen actie ondernemen die een onredelijke of onevenredig grote belasting legt op de infrastructuur van de systemen of netwerken van Blueberry Software Limited, of systemen of netwerken die verbonden zijn met de systemen of netwerken van Blueberry Software Limited.

You shall not use any device, software or routine to interfere or attempt to interfere with the proper working of the Software, or with any other person’s use of the Software.

You shall not use the Software for any purpose that is unlawful or prohibited by this Agreement.

Blueberry Software Ltd. reserves the right to bar any restricted activity outlined above and to disable the accounts of any users engaging in such activities.

2.8 BEPERKINGEN OP HET GEBRUIK OP MEERDERE COMPUTERS

Wanneer de Software zonder betaling wordt gebruikt, stelt Blueberry Software Ltd. geen beperkingen aan het aantal PC's waarop u de software mag installeren.

If you have purchased a license, then this license may only be used on the number of PCs that were purchased.

3. BILLING AND REFUNDS

While the Software may be used without payment, optional licenses are available from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment.

Vergoedingen en kosten kunnen binnen 30 dagen na de aankoopdatum worden terugbetaald. Op een latere datum dan 30 dagen na de aankoopdatum worden alle kosten en vergoedingen niet terugbetaald.

4. WARRANTIES AND LIMITATIONS OF LIABILITY

You acknowledge and agree that the entire risk arising out of use or performance of the Software remains with the user. While the Software may be used without payment, optional licenses are available from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment. Fees and charges may be refunded within 30 days of the purchase date. At a later date than 30 days after the purchase date, all fees and charges are nonrefundable.

4.1 BEPERKTE GARANTIE

DE SOFTWARE (MET INBEGRIP VAN, MAAR NIET BEPERKT TOT, DE SOFTWARETOEPASSING EN DOCUMENTATIE(S)) WORDT GELEVERD "ZOALS DEZE IS" ZONDER ENIGE GARANTIE, HETZIJ EXPRESS OF IMPLICIET, MET INBEGRIP VAN, MAAR NIET BEPERKT TOT, GARANTIES OF VOORWAARDEN VAN KWALITEIT, PRESTATIES, NIET-INBREUK, VERKOOPBAARHEID OF GESCHIKTHEID VOOR GEBRUIK VOOR EEN BEPAALD DOEL. BLUEBERRY SOFTWARE LTD. GEEFT GEEN GARANTIE DAT DE DIENSTEN ONONDERBROKEN, TIJDIG OF FOUTVRIJ ZULLEN ZIJN. UW GEBRUIK VAN DE SOFTWARE EN/OF DIENSTEN IS VOOR UW EIGEN RISICO.

4.2 BEPERKINGEN VAN AANSPRAKELIJKHEID

NOCH BLUEBERRY SOFTWARE LTD. NOCH HAAR LICENTIEGEVERS ZIJN OP ENIGERLEI WIJZE AANSPRAKELIJK VOOR ENIG VERLIES OF SCHADE VAN WELKE AARD DAN OOK DIE VOORTVLOEIT UIT DE SOFTWARE OF ENIG GEBRUIK VAN DEZE SOFTWARE EN/OF DIENSTEN, MET INBEGRIP VAN MAAR NIET BEPERKT TOT VERLIES VAN GEGEVENS, VERLIES VAN GOODWILL, WINSTDERVING, WERKONDERBREKING, COMPUTERSTORINGEN OF -STORINGEN, OF ENIGE EN ALLE ANDERE SCHADE OF VERLIEZEN.

NEITHER BLUEBERRY SOFTWARE LTD. NOR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR ANY ADDITIONAL COSTS, INCLUDING, BUT NOT LIMITED TO ADDITIONAL CHARGES FROM MOBILE/TELECOMMUNICATION OPERATORS ARISING OUT OF THE SERVICES OR ANY USE OF THE SERVICES. NEITHER BLUEBERRY SOFTWARE LTD. NOR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR ANY DAMAGES OR LOSS ARISING OUT OF THE USE OF THE SERVICES BY ANY 3RD PARTY PERSON OR ORGANISATION.

5 TOEPASSELIJK RECHT EN ALGEMENE BEPALINGEN

Deze overeenkomst wordt beheerst door, en zal worden geïnterpreteerd in overeenstemming met, de wetten van Engeland en Wales. Deze overeenkomst kan alleen worden gewijzigd door een licentie-addendum dat bij deze licentie kan worden gevoegd of eraan kan worden toegevoegd.
