Flashback Video Converter

Please read this End-User License Agreement (“Agreement”) carefully before installing or using FlashBack Video Converter (the “Software”).

By installing or using FlashBack Video Converter, you are agreeing to be bound by the terms and conditions of this Agreement.

If you do not agree to the terms of this Agreement, do not install or use FlashBack Video Converter.

1. DÉFINITIONS

1.1 Software – FlashBack Video Converter

1.2 You/User – the end user of FlashBack Video Converter.

1.3 Agreement – this End User License Agreement (EULA)

1.4 Blueberry Software Ltd. Partners – companies authorized by Blueberry Software Ltd. to sell its products or services.

2. SOFTWARE LICENSE, USE AND DISTRIBUTION

2.1 LICENSE

This software is licensed and not sold. Blueberry Software Ltd. grants you a limited non-exclusive license (“License”) to install and use the Software as long as you comply with the terms and conditions of this Agreement. Any future Software updates may include an updated End User License Agreement. Please read it carefully before installing Software updates.

2.2 TRANSFERT

Vous n'êtes pas autorisé à vendre, louer, céder ou sous-licencier le logiciel à une autre partie. Cette licence est non exclusive et non transférable.

Seuls les partenaires de Blueberry Software Ltd. sont autorisés à revendre les licences du logiciel.

2.3 DISTRIBUTION

Le paquet d'installation du Logiciel peut être distribué librement, sauf exceptions mentionnées ci-dessous, à condition que le paquet de distribution ne soit pas modifié. Aucune personne ou société ne peut facturer des frais pour la distribution du logiciel sans l'autorisation écrite du détenteur des droits d'auteur. Le logiciel ne peut être regroupé ou distribué avec aucun autre paquet sans l'autorisation du détenteur des droits d'auteur. Tous les enregistrements vidéo, audio et les captures d'écran réalisés avec le logiciel peuvent être utilisés et distribués librement, à condition que vous vous assuriez qu'ils sont conformes aux lois locales applicables (y compris, mais sans s'y limiter, à la loi locale sur le droit d'auteur).

2.4 RÉSILIATION

Vos droits de licence sur le logiciel en vertu du présent contrat seront automatiquement résiliés sans préavis de la part de Blueberry Software Ltd. si vous ne respectez pas les termes ou conditions du présent contrat. Après la résiliation de cette licence, vous devez cesser d'utiliser le logiciel et aucun remboursement ne sera possible.

2.5 CONSENTEMENT À LA COLLECTE DE DONNÉES D'UTILISATION, UTILISATION DE VOTRE CONNEXION INTERNET

The Software by default collects anonymous technical information about your use of the application in order to provide an optimal customer support experience and to improve the functionality and usability of the Software. If you do not agree to Blueberry Software’s collection of this information, do not install or use Software.

You agree that FlashBack may use an internet connection to provide full Software functionality, including but not limited to: validating your license and checking for Software updates.

2.6 PROPRIÉTÉ

All copyrights and all other intellectual properties to the Software are exclusively owned or licensed by Blueberry Software Ltd. This Software is licensed and not sold. All rights not expressly granted here are reserved by Blueberry Software Ltd.

2,7 RESTRICTIONS

Il est interdit d'utiliser, de copier, de publier, de partager, d'émuler, de cloner, de louer, de vendre, de modifier, de décompiler, de désassembler, de faire de l'ingénierie inverse ou de transférer le programme sous licence ou tout sous-ensemble du programme sous licence, sauf dans les cas prévus par le présent accord. Toute utilisation non autorisée de ce type entraînera la résiliation immédiate et automatique de la présente licence et pourra donner lieu à des poursuites pénales et/ou civiles.

You shall not attempt to gain unauthorized access to any portion or feature of the Software, or any other systems or networks accessed by the Software or to any Blueberry Software Ltd. server, by hacking, password “mining”, or any other illegitimate means.

Vous ne devez pas sonder, scanner ou tester la vulnérabilité de tout serveur de Blueberry Software Ltd., ni violer les mesures de sécurité ou d'authentification sur tout serveur de Blueberry Software Ltd. ou tout réseau connecté à ces serveurs.

Vous ne devez pas entreprendre d'action qui impose une charge déraisonnable ou disproportionnée sur l'infrastructure des systèmes ou réseaux de Blueberry Software Limited, ou tout système ou réseau connecté aux systèmes ou réseaux de Blueberry Software Limited.

You shall not use any device, software or routine to interfere or attempt to interfere with the proper working of the Software, or with any other person’s use of the Software.

You shall not use the Software for any purpose that is unlawful or prohibited by this Agreement.

Blueberry Software Ltd. reserves the right to bar any restricted activity outlined above and to disable the accounts of any users engaging in such activities.

2.8 LIMITATIONS ON USAGE ON MULTIPLE PCS

Lorsque le logiciel est utilisé sans paiement, Blueberry Software Ltd. n'impose aucune limite au nombre de PC sur lesquels vous pouvez installer le logiciel.

If you have purchased a license, then this license may only be used on the number of PCs that were purchased.

3. BILLING AND REFUNDS

While the Software may be used without payment, optional licenses are available from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment.

Les frais et les charges peuvent être remboursés dans les 30 jours suivant la date d'achat. À une date ultérieure à 30 jours après la date d'achat, tous les frais et charges ne sont pas remboursables.

4. WARRANTIES AND LIMITATIONS OF LIABILITY

You acknowledge and agree that the entire risk arising out of use or performance of the Software remains with the user. While the Software may be used without payment, optional licenses are available from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment. Fees and charges may be refunded within 30 days of the purchase date. At a later date than 30 days after the purchase date, all fees and charges are nonrefundable.

4.1 GARANTIE LIMITÉE

LE LOGICIEL (Y COMPRIS, SANS S'Y LIMITER, L'APPLICATION LOGICIELLE ET LA (LES) DOCUMENTATION(S)) EST FOURNI "EN L'ÉTAT" SANS GARANTIE D'AUCUNE SORTE, QU'ELLE SOIT EXPRESS OU IMPLICITE, Y COMPRIS, SANS S'Y LIMITER, LES GARANTIES OU CONDITIONS DE QUALITÉ, DE PERFORMANCE, DE NON-VIOLATION, DE QUALITÉ MARCHANDE OU D'ADÉQUATION À UN USAGE PARTICULIER. BLUEBERRY SOFTWARE LTD. NE GARANTIT PAS QUE LES SERVICES SERONT ININTERROMPUS, OPPORTUNS OU SANS ERREUR. L'UTILISATION DU LOGICIEL ET/OU DES SERVICES SE FAIT À VOS PROPRES RISQUES.

4.2 LIMITATIONS DE LA RESPONSABILITÉ

NI BLUEBERRY SOFTWARE LTD. NI SES CONCÉDANTS DE LICENCE NE PEUVENT ÊTRE TENUS RESPONSABLES DE QUELQUE MANIÈRE QUE CE SOIT DE TOUTE PERTE OU DE TOUT DOMMAGE DE QUELQUE NATURE QUE CE SOIT DÉCOULANT DU LOGICIEL OU DE TOUTE UTILISATION DE CE LOGICIEL OU/ET DE CES SERVICES, Y COMPRIS, MAIS SANS S'Y LIMITER, LA PERTE DE DONNÉES, LA PERTE DE CLIENTÈLE, LA PERTE DE BÉNÉFICES, L'ARRÊT DE TRAVAIL, LA PANNE OU LE DYSFONCTIONNEMENT DE L'ORDINATEUR, OU TOUT AUTRE DOMMAGE OU PERTE.

NEITHER BLUEBERRY SOFTWARE LTD. NOR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR ANY ADDITIONAL COSTS, INCLUDING, BUT NOT LIMITED TO ADDITIONAL CHARGES FROM MOBILE/TELECOMMUNICATION OPERATORS ARISING OUT OF THE SERVICES OR ANY USE OF THE SERVICES. NEITHER BLUEBERRY SOFTWARE LTD. NOR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR ANY DAMAGES OR LOSS ARISING OUT OF THE USE OF THE SERVICES BY ANY 3RD PARTY PERSON OR ORGANISATION.

5 DROIT RÉG RÉG RÉG RÉG RÉG RÉG ET DISPOSITIONS GÉNÉRALES

Le présent accord est régi par les lois de l'Angleterre et du Pays de Galles et doit être interprété conformément à celles-ci. Cet accord ne peut être modifié que par un addendum de licence qui peut accompagner ou être ajouté à cette licence.
