1. DÉFINITIONS

1.2 Vous/Utilisateur – l'utilisateur final de FlashBack Camigo.

1.3 Accord – ce Contrat de Licence Utilisateur Final (CLUF)

1.4 Partenaires de Blueberry Software Ltd. – entreprises autorisées par Blueberry Software Ltd. à vendre ses produits ou services.



2. LICENCE DE LOGICIEL, UTILISATION ET DISTRIBUTION


2.1 LICENCE

Ce logiciel est concédé sous licence et non vendu. Blueberry Software Ltd. vous accorde une licence limitée non exclusive (« Licence ») pour installer et utiliser le Logiciel tant que vous respectez les termes et conditions de cet Accord. Toute mise à jour future du Logiciel peut inclure une version mise à jour du Contrat de Licence Utilisateur Final. Veuillez le lire attentivement avant d'installer les mises à jour du Logiciel.


2.2 TRANSFERT

Vous ne pouvez pas vendre, louer, prêter ou accorder une sous-licence du Logiciel à une autre partie. Cette Licence est non exclusive et non transférable.

Seuls les partenaires de Blueberry Software Ltd. sont autorisés à revendre des licences de Logiciel.


2.3 DISTRIBUTION

Le paquet d'installation du Logiciel peut être librement distribué, à l'exception des notes spécifiées ci-dessous, à condition que le paquet de distribution ne soit pas modifié. Aucune personne ou entreprise ne peut facturer des frais pour la distribution du Logiciel sans l'autorisation écrite du détenteur des droits d'auteur. Le Logiciel ne peut pas être regroupé ou distribué avec un autre paquet sans la permission du détenteur des droits d'auteur. Tous les enregistrements vidéo, les enregistrements audio et les captures d'écran enregistrés avec le Logiciel peuvent être utilisés et distribués librement à condition que vous vous assuriez qu'ils respectent les lois locales applicables (y compris, mais sans s'y limiter, votre loi locale sur le droit d'auteur).


2.4 RÉSILIATION

Vos droits de licence sur le Logiciel en vertu de cet Accord prendront automatiquement fin sans aucun avis de Blueberry Software Ltd. si vous ne respectez pas les conditions de cet Accord. Après la résiliation de cette Licence, vous devez cesser d'utiliser le Logiciel et aucun remboursement ne sera disponible.


2.5 CONSENTEMENT À LA COLLECTE DE DONNÉES D'UTILISATION, UTILISER VOTRE CONNEXION INTERNET

Le Logiciel collecte par défaut des informations techniques anonymes sur votre utilisation de l'application afin de fournir une expérience de support client optimale et d'améliorer la fonctionnalité et l'utilisabilité du Logiciel. Si vous n'acceptez pas la collecte de ces informations par Blueberry Software, n'installez pas ou n'utilisez pas le Logiciel.

Vous acceptez que FlashBack puisse utiliser une connexion Internet pour fournir une fonctionnalité logicielle complète, y compris, mais sans s'y limiter : la validation de votre licence et la vérification des mises à jour du Logiciel.


2.6 PROPRIÉTÉ

Tous les droits d'auteur et toutes autres propriétés intellectuelles relatives au Logiciel sont exclusivement détenus ou licenciés par Blueberry Software Ltd. Ce Logiciel est concédé sous licence et non vendu. Tous les droits non expressément accordés ici sont réservés par Blueberry Software Ltd.


2.7 RESTRICTIONS
Vous ne pouvez pas utiliser, copier, publier, partager, émuler, cloner, louer, prêter, vendre, modifier, décompiler, désassembler, réaliser une ingénierie inverse du programme sous licence, ou transférer le programme sous licence, ou tout sous-ensemble du programme sous licence, sauf dans les cas prévus dans cet accord. Toute utilisation non autorisée entraînera la résiliation immédiate et automatique de cette Licence et pourra entraîner des poursuites pénales et/ou civiles.

Vous ne devez pas tenter d'accéder sans autorisation à une partie ou fonctionnalité du Logiciel, ou à tout autre système ou réseau accessible par le Logiciel, ou à tout serveur de Blueberry Software Ltd., par piratage, exploration de mots de passe ou tout autre moyen illégitime.

Vous ne devez pas sonder, analyser ou tester la vulnérabilité de tout serveur de Blueberry Software Ltd., ni enfreindre les mesures de sécurité ou d'authentification sur tout serveur de Blueberry Software Ltd. ou tout réseau connecté à ces serveurs.

Vous ne devez pas prendre de mesures qui imposent une charge déraisonnable ou disproportionnellement lourde sur l'infrastructure des systèmes ou réseaux de Blueberry Software Ltd., ou tout système ou réseau connecté aux systèmes ou réseaux de Blueberry Software Ltd.

Vous ne devez utiliser aucun appareil, logiciel ou routine pour interférer ou tenter d'interférer avec le bon fonctionnement du Logiciel, ou avec l'utilisation du Logiciel par toute autre personne.

Vous ne devez pas utiliser le Logiciel à des fins illégales ou interdites par cet Accord.

Blueberry Software Ltd. se réserve le droit d'interdire toute activité restreinte décrite ci-dessus et de désactiver les comptes de tout utilisateur s'engageant dans de telles activités.


2.8 LIMITATIONS SUR L'UTILISATION SUR PLUSIEURS PC

Lorsque le Logiciel est utilisé sans paiement, Blueberry Software Ltd. ne met aucune limite sur le nombre de PC sur lesquels vous pouvez installer le logiciel.

Si vous avez acheté une licence, alors cette licence ne peut être utilisée que sur le nombre de PC acheté.



3. FACTURATION ET REMBOURSEMENTS

Bien que le Logiciel puisse être utilisé sans paiement, des licences optionnelles sont disponibles auprès de Blueberry Software Ltd qui donnent accès à des fonctionnalités supplémentaires et lèvent les restrictions sur les fonctionnalités disponibles sans paiement.

Les frais peuvent être remboursés dans les 30 jours suivant la date d'achat. Passé ce délai de 30 jours après l'achat, tous les frais ne sont pas remboursables.



4. GARANTIES ET LIMITATIONS DE RESPONSABILITÉ

Vous reconnaissez et acceptez que l'entière responsabilité liée à l'utilisation ou aux performances du Logiciel repose sur l'utilisateur. Bien que le Logiciel puisse être utilisé sans paiement, des licences optionnelles sont disponibles auprès de Blueberry Software Ltd qui permettent d'accéder à des fonctionnalités supplémentaires et suppriment les restrictions sur ces fonctionnalités disponibles sans paiement. Les frais peuvent être remboursés dans les 30 jours suivant la date d'achat. Passé ce délai de 30 jours après l'achat, tous les frais ne sont pas remboursables.

Cet accord est régi par, et doit être interprété conformément aux lois d'Angleterre et du pays de Galles. Cet accord ne peut être modifié que par un avenant à la licence qui peut accompagner ou être ajouté à cette licence.
