Flashback Video Converter
Please read this End-User License Agreement (“Agreement”) carefully before installing or using FlashBack Video Converter (the “Software”).
By installing or using FlashBack Video Converter, you are agreeing to be bound by the terms and conditions of this Agreement.
If you do not agree to the terms of this Agreement, do not install or use FlashBack Video Converter.
1. DEFINICIONES
1.1 Software – FlashBack Video Converter
1.2 You/User – the end user of FlashBack Video Converter.
1.3 Agreement – this End User License Agreement (EULA)
1.4 Blueberry Software Ltd. Partners – companies authorized by Blueberry Software Ltd. to sell its products or services.
2. SOFTWARE LICENSE, USE AND DISTRIBUTION
2.1 LICENSE
This software is licensed and not sold. Blueberry Software Ltd. grants you a limited non-exclusive license (“License”) to install and use the Software as long as you comply with the terms and conditions of this Agreement. Any future Software updates may include an updated End User License Agreement. Please read it carefully before installing Software updates.
2.2 TRANSFERENCIA
Usted no puede vender, alquilar, arrendar o sublicenciar el Software a otra parte. Esta licencia no es exclusiva ni transferible.
Sólo los socios de Blueberry Software Ltd. están autorizados a revender licencias de software.
2.3 DISTRIBUCIÓN
El paquete de instalación del Software puede ser distribuido libremente, con las excepciones que se indican a continuación, siempre que el paquete de distribución no sea modificado. Ninguna persona o empresa puede cobrar una tarifa por la distribución del Software sin el permiso por escrito del titular de los derechos de autor. El Software no puede ser agrupado o distribuido con ningún otro paquete sin el permiso del titular de los derechos de autor. 2.4 TERMINACIÓN
Sus derechos de licencia para el Software bajo este Acuerdo terminarán automáticamente sin ningún aviso de Blueberry Software Ltd. si usted no cumple con cualquier término o condición de este Acuerdo. Después de la terminación de esta licencia, usted debe dejar de usar el Software y no habrá reembolso.
2.5 CONSENTIMIENTO PARA RECOGER DATOS DE USO, UTILIZAR SU CONEXIÓN A INTERNET
The Software by default collects anonymous technical information about your use of the application in order to provide an optimal customer support experience and to improve the functionality and usability of the Software. If you do not agree to Blueberry Software’s collection of this information, do not install or use Software.
You agree that FlashBack may use an internet connection to provide full Software functionality, including but not limited to: validating your license and checking for Software updates.
2.6 PROPIEDAD
All copyrights and all other intellectual properties to the Software are exclusively owned or licensed by Blueberry Software Ltd. This Software is licensed and not sold. All rights not expressly granted here are reserved by Blueberry Software Ltd.
2.7 RESTRICCIONES
Usted no puede utilizar, copiar, publicar, compartir, emular, clonar, alquilar, arrendar, vender, modificar, descompilar, desensamblar, realizar ingeniería inversa o transferir el programa con licencia, o cualquier subconjunto del programa con licencia, salvo lo dispuesto en este acuerdo. Cualquier uso no autorizado de este tipo dará lugar a la terminación inmediata y automática de esta licencia y puede dar lugar a un proceso penal y/o civil.
You shall not attempt to gain unauthorized access to any portion or feature of the Software, or any other systems or networks accessed by the Software or to any Blueberry Software Ltd. server, by hacking, password “mining”, or any other illegitimate means.
El usuario no podrá sondear, escanear o probar la vulnerabilidad de ningún servidor de Blueberry Software Ltd., ni violar las medidas de seguridad o autenticación de ningún servidor de Blueberry Software Ltd. ni de ninguna red conectada a estos servidores.
El usuario no llevará a cabo ninguna acción que imponga una carga irrazonable o desproporcionada a la infraestructura de los sistemas o redes de Blueberry Software Limited, o a cualquier sistema o red conectado a los sistemas o redes de Blueberry Software Limited.
You shall not use any device, software or routine to interfere or attempt to interfere with the proper working of the Software, or with any other person’s use of the Software.
You shall not use the Software for any purpose that is unlawful or prohibited by this Agreement.
Blueberry Software Ltd. reserves the right to bar any restricted activity outlined above and to disable the accounts of any users engaging in such activities.
2.8 LIMITACIONES DE USO EN MÚLTIPLES PCS
Cuando el software se utiliza sin pagar, Blueberry Software Ltd. no pone límites al número de ordenadores en los que se puede instalar el software.
If you have purchased a license, then this license may only be used on the number of PCs that were purchased.
3. BILLING AND REFUNDS
While the Software may be used without payment, optional licenses are available from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment.

4. WARRANTIES AND LIMITATIONS OF LIABILITY
You acknowledge and agree that the entire risk arising out of use or performance of the Software remains with the user. While the Software may be used without payment, optional licenses are available from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment. Fees and charges may be refunded within 30 days of the purchase date. At a later date than 30 days after the purchase date, all fees and charges are nonrefundable.
4.1 GARANTÍA LIMITADA
EL SOFTWARE (INCLUYENDO, SIN LIMITACIÓN, LA APLICACIÓN DE SOFTWARE Y LA(S) DOCUMENTACIÓN(ES)) SE PROPORCIONA "TAL CUAL", SIN GARANTÍA DE NINGÚN TIPO, YA SEA EXPRESS O IMPLÍCITA, INCLUYENDO, SIN LIMITACIÓN, LAS GARANTÍAS O CONDICIONES DE CALIDAD, RENDIMIENTO, NO INFRACCIÓN, COMERCIABILIDAD O IDONEIDAD PARA EL USO DE UN PROPÓSITO PARTICULAR. BLUEBERRY SOFTWARE LTD. NO GARANTIZA QUE LOS SERVICIOS SEAN ININTERRUMPIDOS, PUNTUALES O ESTÉN LIBRES DE ERRORES. EL USO QUE USTED HAGA DEL SOFTWARE Y/O DE LOS SERVICIOS ES POR SU CUENTA Y RIESGO.
4.2 LIMITACIONES DE RESPONSABILIDAD
NI BLUEBERRY SOFTWARE LTD. NI SUS LICENCIANTES SERÁN RESPONSABLES DE NINGUNA MANERA POR CUALQUIER PÉRDIDA O DAÑO DE CUALQUIER TIPO QUE SURJA DEL SOFTWARE O DE CUALQUIER USO DE ESTE SOFTWARE O/Y SERVICIOS, INCLUYENDO, SIN LIMITACIÓN, LA PÉRDIDA DE DATOS, LA PÉRDIDA DE BUENA VOLUNTAD, LA PÉRDIDA DE BENEFICIOS, LA INTERRUPCIÓN DEL TRABAJO, EL FALLO O MAL FUNCIONAMIENTO DEL ORDENADOR, O CUALQUIER OTRO DAÑO O PÉRDIDA.
NEITHER BLUEBERRY SOFTWARE LTD. NOR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR ANY ADDITIONAL COSTS, INCLUDING, BUT NOT LIMITED TO ADDITIONAL CHARGES FROM MOBILE/TELECOMMUNICATION OPERATORS ARISING OUT OF THE SERVICES OR ANY USE OF THE SERVICES. NEITHER BLUEBERRY SOFTWARE LTD. NOR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR ANY DAMAGES OR LOSS ARISING OUT OF THE USE OF THE SERVICES BY ANY 3RD PARTY PERSON OR ORGANISATION.
5 DERECHO APLICABLE Y DISPOSICIONES GENERALES
Este acuerdo se rige por las leyes de Inglaterra y Gales y se interpretará de acuerdo con ellas. Este acuerdo sólo puede ser modificado por un anexo de licencia que puede acompañar o añadirse a esta licencia.
