Flashback Video Converter

Please read this End-User License Agreement (“Agreement”) carefully before installing or using FlashBack Video Converter (the “Software”).

By installing or using FlashBack Video Converter, you are agreeing to be bound by the terms and conditions of this Agreement.

If you do not agree to the terms of this Agreement, do not install or use FlashBack Video Converter.

1. DEFINITIONER

1.1 Software – FlashBack Video Converter

1.2 You/User – the end user of FlashBack Video Converter.

1.3 Agreement – this End User License Agreement (EULA)

1.4 Blueberry Software Ltd. Partners – companies authorized by Blueberry Software Ltd. to sell its products or services.

2. SOFTWARE LICENSE, USE AND DISTRIBUTION

2.1 LICENSE

This software is licensed and not sold. Blueberry Software Ltd. grants you a limited non-exclusive license (“License”) to install and use the Software as long as you comply with the terms and conditions of this Agreement. Any future Software updates may include an updated End User License Agreement. Please read it carefully before installing Software updates.

2.2 ÖVERFÖRING

Du får inte sälja, hyra ut, leasa eller underlicensiera Programvaran till en annan part. Denna licens är icke-exklusiv och kan inte överlåtas.

Bara Blueberry Software Ltd. Partners har behörighet att sälja programvarulicenser vidare.

2.3 FÖRDELNING

Programvaruinstallationspaketet kan distribueras fritt, med undantag som anges nedan, förutsatt att distributionspaketet inte ändras. Ingen person eller företag får ta ut någon avgift för distributionen av Programvaran utan skriftligt tillstånd från upphovsrättsinnehavaren. Programvaran får inte paketeras eller distribueras med något annat paket utan tillstånd från upphovsrättsinnehavaren. Alla videoinspelningar, ljudinspelningar och skärmdumpar som spelats in med Programvaran kan användas fritt och distribueras förutsatt att du säkerställer att de följer gällande lokala lagar (inklusive, men inte begränsat till, din lokala upphovsrättslag).

2.4 UPPSÄGNING

Dina licensrättigheter till Programvaran enligt detta avtal upphör automatiskt utan föregående meddelande från Blueberry Software Ltd. om du inte uppfyller några villkor eller villkor i detta avtal. Efter uppsägningen av denna licens måste du upphöra att använda Programvaran och ingen återbetalning kommer att vara tillgänglig.

The Software by default collects anonymous technical information about your use of the application in order to provide an optimal customer support experience and to improve the functionality and usability of the Software. If you do not agree to Blueberry Software’s collection of this information, do not install or use Software.

You agree that FlashBack may use an internet connection to provide full Software functionality, including but not limited to: validating your license and checking for Software updates.

2.6 ÄGANDE

All copyrights and all other intellectual properties to the Software are exclusively owned or licensed by Blueberry Software Ltd. This Software is licensed and not sold. All rights not expressly granted here are reserved by Blueberry Software Ltd.

2.7 BEGRÄNSNINGAR

Du får inte använda, kopiera, publicera, dela, emulera, klona, hyra, leasa, sälja, modifiera, dekompilera, demontera, på annat sätt bakåtkompilera eller överföra det licensierade programmet eller någon delmängd av det licensierade programmet, förutom vad som föreskrivs i detta avtal. Sådan obehörig användning ska leda till omedelbar och automatisk uppsägning av denna licens och kan leda till straffrättsliga och/eller civilrättsliga åtal.

You shall not attempt to gain unauthorized access to any portion or feature of the Software, or any other systems or networks accessed by the Software or to any Blueberry Software Ltd. server, by hacking, password “mining”, or any other illegitimate means.

Du får inte undersöka, skanna eller testa sårbarheten hos någon Blueberry Software Ltd. server, eller bryta mot säkerhets- eller autentiseringsåtgärderna på någon Blueberry Software Ltd. server eller något nätverk som är anslutet till dessa servrar.

Du får inte vidta några åtgärder som medför en orimlig eller oproportionerligt stor belastning på infrastrukturen i Blueberry Software Limiteds system eller nätverk, eller system eller nätverk som är anslutna till Blueberry Software Limiteds system eller nätverk.

You shall not use any device, software or routine to interfere or attempt to interfere with the proper working of the Software, or with any other person’s use of the Software.

You shall not use the Software for any purpose that is unlawful or prohibited by this Agreement.

Blueberry Software Ltd. reserves the right to bar any restricted activity outlined above and to disable the accounts of any users engaging in such activities.

2.8 BEGRÄNSNINGAR AV ANVÄNDNINGEN PÅ FLERA DATORER

När Programvaran används utan betalning Blueberry Software Ltd. sätter inga gränser för antalet datorer du får installera programvaran på.

If you have purchased a license, then this license may only be used on the number of PCs that were purchased.

3. BILLING AND REFUNDS

While the Software may be used without payment, optional licenses are available from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment.

Avgifter och avgifter kan återbetalas inom 30 dagar från inköpsdatumet. Vid ett senare tillfälle än 30 dagar efter inköpsdatum är alla avgifter och avgifter ej återbetalningsbara.

4. WARRANTIES AND LIMITATIONS OF LIABILITY

You acknowledge and agree that the entire risk arising out of use or performance of the Software remains with the user. While the Software may be used without payment, optional licenses are available from Blueberry Software Ltd that grant access to additional features and remove restrictions on those features available for use without payment. Fees and charges may be refunded within 30 days of the purchase date. At a later date than 30 days after the purchase date, all fees and charges are nonrefundable.

BLUEBERRY SOFTWARE LTD. GER INGEN GARANTI FÖR ATT TJÄNSTERNA KOMMER ATT VARA OAVBRUTNA, I RÄTT TID ELLER FELFRIA. DIN ANVÄNDNING AV PROGRAMVARAN OCH/ELLER TJÄNSTERNA ÄR PÅ EGEN RISK.

4.2 ANSVARSBEGRÄNSNINGAR

INGENDERA BLUEBERRY SOFTWARE LTD. ELLER DESS LICENSGIVARE SKA PÅ NÅGOT SÄTT VARA ANSVARIGA FÖR FÖRLUST ELLER SKADA AV NÅGOT SLAG SOM UPPSTÅR TILL FÖLJD AV PROGRAMVARAN ELLER NÅGON ANVÄNDNING AV DENNA PROGRAMVARA ELLER / OCH TJÄNSTER, INKLUSIVE UTAN BEGRÄNSNING FÖRLUST AV DATA, FÖRLUST AV GOODWILL, FÖRLUST AV VINSTER, ARBETSSTOPP, DATORFEL ELLER FELFUNKTION, ELLER ALLA ANDRA SKADOR ELLER FÖRLUSTER.

NEITHER BLUEBERRY SOFTWARE LTD. NOR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR ANY ADDITIONAL COSTS, INCLUDING, BUT NOT LIMITED TO ADDITIONAL CHARGES FROM MOBILE/TELECOMMUNICATION OPERATORS ARISING OUT OF THE SERVICES OR ANY USE OF THE SERVICES. NEITHER BLUEBERRY SOFTWARE LTD. NOR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR ANY DAMAGES OR LOSS ARISING OUT OF THE USE OF THE SERVICES BY ANY 3RD PARTY PERSON OR ORGANISATION.

5 REGLERANDE LAGAR OCH ALLMÄNNA BESTÄMMELSER

Detta avtal regleras av och ska tolkas i enlighet med englands och Wales lagar. Detta avtal får endast ändras av ett licenstillägg som kan åtfölja eller läggas till i denna licens.
